Luggage Lifeline Terms of Service

Luggage Lifeline is a brand, trade name, and service offering operated by or on behalf of the company Kennedy Circle, a Delaware limited liability company, as part of the Kennedy Circle group of companies.
These Terms of Service, together with any order form, checkout page, mobile-app terms, claim instructions, policies incorporated by reference, and any other terms presented to you at purchase or use, form a legally binding agreement between you and Kennedy Circle, a Delaware corporation/Delaware limited liability company and a member of the Kennedy Circle group of companies.
References in these Terms to “Luggage Lifeline” refer to the Luggage Lifeline brand and Service. References to “Kennedy Circle group of companies” mean the Company’s parent companies, subsidiaries, affiliates, commonly controlled entities, and related operating companies.
Unless expressly stated otherwise in writing, your contract is with the Company named above and not with every company in the Kennedy Circle group of companies. No Kennedy Circle group company is responsible for the obligations of another Kennedy Circle group company solely by virtue of being affiliated with it, except where required by applicable law or expressly agreed in writing.
Please read these Terms carefully. By creating an account, purchasing the Service, submitting a claim, using our website, app, hotline, delivery service, or otherwise accessing the Service, you agree to these Terms. If you do not agree, do not purchase or use the Service.
Important Notice: These Terms include limitations of liability, disclaimers of warranties, a binding arbitration agreement, a class-action waiver, and a jury-trial waiver, to the extent permitted by law.
1. The Service; Logistics Planning and Sourcing Only
Luggage Lifeline provides a pre-paid logistics planning, sourcing, procurement, packing, and delivery coordination service for eligible travelers whose checked luggage does not arrive at their destination airport during an eligible covered trip.
The Service is designed to help coordinate the sourcing and delivery of one curated “Essentials Vacation Suitcase” to the named customer’s confirmed accommodation in a covered destination, subject to these Terms.
Luggage Lifeline is not an insurance company, insurance producer, insurance broker, travel insurer, baggage insurer, or claims-adjustment service. The Service is not insurance, does not involve risk pooling, does not indemnify you for a covered loss, and does not reimburse you for the value of your original luggage or its contents. The Service is a logistics planning and sourcing product that may be activated only if you submit a valid missing-luggage claim under these Terms.
The Service does not guarantee that your airline, airport, travel provider, insurer, credit-card issuer, or other third party will locate, replace, reimburse, or compensate you for your original luggage. You remain solely responsible for pursuing any airline, insurance, credit-card, statutory, or other claim related to your original luggage.
You keep the delivered Essentials Vacation Suitcase regardless of whether your original luggage later arrives.
2. Covered Destinations
The Service is currently available only for eligible destination airports and confirmed accommodations in the following covered Mediterranean destinations:

Cyprus

Malta
We may expand, limit, suspend, or discontinue covered destinations, airports, cities, islands, rural areas, or service zones at any time. Coverage is not guaranteed unless expressly confirmed for your specific eligible flight and accommodation.
3. Service Fee
The Service fee is shown at checkout. The current standard fee is $420, or the equivalent amount shown at checkout in U.S. dollars or another supported currency, plus any applicable taxes, fees, or currency-conversion charges.
The amount displayed and accepted at checkout is the amount you agree to pay. Currency conversions, bank fees, foreign transaction fees, and card-issuer fees are not controlled by us and are not refundable by us.
4. Eligible Customer; Non-Transferability
Each purchase is valid only for the individual customer whose name is listed on the checkout form at the time of purchase.
The Service is personal to that named customer and may not be transferred, assigned, shared, resold, gifted, or applied to another traveler, including a spouse, family member, travel companion, business colleague, or group member.
If multiple travelers wish to be covered by the Service, each traveler must purchase a separate Service in their own name.
We may require identity verification before accepting a claim or completing delivery. If the person submitting the claim does not match the named customer listed at checkout, we may reject the claim without refund, except where otherwise required by applicable law.
5. One Eligible Flight Within Twelve Months
Each purchase is valid for one named customer and one eligible flight itinerary to a covered Mediterranean destination within 12 months from the date of purchase.
For purposes of these Terms, an “Eligible Flight” means a commercial airline itinerary for the named customer with a destination airport located in one of our covered service countries or covered service areas.
The Service may be used only once. Once a claim is submitted and fulfilled, rejected, refunded, cancelled, expired, or otherwise resolved, the purchase is considered used or closed and cannot be applied to another flight, trip, traveler, destination, or future booking.
If the Service is not activated for an Eligible Flight within 12 months from purchase, the purchase expires and has no remaining value, unless otherwise required by applicable law or expressly agreed by us in writing.
You are responsible for registering or confirming your Eligible Flight details before travel using the method we provide. We are not responsible for any inability to verify or fulfill a claim caused by missing, inaccurate, incomplete, outdated, or late flight information.
6. Eligibility
To purchase or use the Service, you must:

Be at least 18 years old.

Have legal capacity to enter into a binding contract.

Be traveling by air with checked luggage.
-
Be the named customer listed on the checkout form.
-
Have one Eligible Flight to a covered destination within 12 months from purchase.

Provide accurate traveler, flight, accommodation, sizing, contact, and claim information.
-
Have a confirmed accommodation in a covered delivery area.
-
Follow the claim process described in these Terms and in the app, website, hotline, or claim instructions.
We may refuse, suspend, cancel, or deny access to the Service if we reasonably believe you are ineligible, have provided inaccurate information, have violated these Terms, have submitted a fraudulent or abusive claim, or are located outside our covered service area.
7. Account and Customer Information
You are responsible for ensuring that all information you provide is accurate, complete, current, and not misleading. This includes, without limitation:

Your name and contact information.

Flight details and destination airport.
-
Accommodation name, address, booking details, and delivery instructions.
-
Clothing sizes, shoe size, preferences, and essential-item needs.
-
Airline baggage information and claim documentation.
-
Identity-verification information requested by us.
We are not responsible for delays, failed deliveries, substitutions, rejected claims, missed communications, or other losses caused by incorrect, incomplete, outdated, or misleading information provided by you or on your behalf.
8. Purchase, Payment, and Authorization
Payment is due in full at purchase. Payments are processed by our third-party payment processors. By submitting payment information, you authorize us and our payment processors to charge your selected payment method for the Service fee and any applicable taxes or fees.
We do not store full payment-card details unless expressly stated in our Privacy Policy or payment disclosures. Payment processing is subject to the terms and privacy policies of the applicable payment processor.
We may cancel or refuse any order due to suspected fraud, payment failure, pricing error, service-area limitations, unsupported travel details, or other reasonable business or legal reasons.
9. Refund Policy
The Service fee is refundable only under the Refund Policy in Section 17, meaning only if you submit a valid claim for an Eligible Flight and Luggage Lifeline determines that it cannot provide the Essentials Vacation Suitcase for reasons within its reasonable control.
If you do not travel, change your flight, change the named customer, travel to a non-covered destination, fail to register accurate flight details, fail to submit a valid claim, fail to activate the Service within 12 months from purchase, or cancel your purchase for personal reasons, no refund or credit will be issued unless required by applicable law or expressly approved by us in writing.
We may require reasonable verification before processing a cancellation or closing a purchase.
10. Claim Activation Requirements
To activate the Service, you must submit a claim that satisfies all of the following requirements:

You must be the named customer listed on the checkout form.

Your claim must relate to the one Eligible Flight covered by your purchase.

Your Eligible Flight must be within 12 months from the date of purchase.
-
Your destination airport must be located in a covered service country or covered service area.
-
You must report your missing checked luggage through the Luggage Lifeline app, website, or 24/7 hotline within 4 hours after your flight lands at the destination airport.

You must provide the airline-issued Property Irregularity Report, baggage irregularity report, PIR reference number, file reference number, or equivalent airline baggage claim reference.

You must provide proof of your flight, destination airport, checked baggage, and accommodation if requested.
-
You must verify your identity and delivery location using any reasonable verification method we request.
-
You must remain reasonably available to provide us location details to coordinate delivery of your replacement suitcase.
-
Your destination and delivery address must be within our covered service area.
We may verify claims using airline data, airport information, third-party sources, documentation provided by you, or other reasonable methods. We may reject any claim that is late, incomplete, unverifiable, inconsistent, fraudulent, abusive, outside the Service area, submitted by someone other than the named customer, or otherwise not compliant with these Terms.
11. Fraud, Abuse, and Invalid Claims
You may not misuse the Service, submit false information, submit duplicate or fabricated claims, alter documents, impersonate another person, claim for luggage that was not checked, claim for luggage that arrived, claim for another traveler’s luggage, or otherwise attempt to obtain the Essentials Vacation Suitcase by improper means.
If we reasonably determine that a claim is fraudulent, abusive, incomplete, untimely, unverifiable, or invalid, we may deny the claim without refund, suspend or terminate your account, cancel pending orders, and pursue any rights or remedies available to us.
12. Delivery and Fulfillment
If you submit a valid claim, we will use commercially reasonable efforts to source, pack, and deliver one Essentials Vacation Suitcase to your confirmed accommodation.
Estimated delivery windows are generally 24 to 48 hours, depending on location, stock availability, supplier availability, courier availability, weather, traffic, airport conditions, local restrictions, and other operational factors.
Delivery windows are estimates only and are not guaranteed. Time is not of the essence unless we expressly agree otherwise in writing.
We may fulfill orders through third-party suppliers, retailers, logistics providers, couriers, accommodation staff, Kennedy Circle group companies, and other independent service providers. You authorize us to share reasonably necessary information with those providers and group companies to fulfill the Service.
13. Delivery Location and Acceptance
You are responsible for providing a complete and accurate delivery address and ensuring that delivery can be completed. Delivery may be made to you, your travel companion if approved by you, hotel reception, concierge, property manager, villa host, rental accommodation representative, or another person reasonably appearing to be authorized to accept delivery at your accommodation.
Delivery will be deemed complete when the Essentials Vacation Suitcase is delivered to the confirmed accommodation, accepted by an authorized or apparently authorized person, placed in a location approved by you or the accommodation, or otherwise marked delivered by the courier or delivery partner using commercially reasonable proof of delivery.
We are not responsible for loss, theft, damage, delay, or misplacement after delivery is completed.
14. Essentials Vacation Suitcase Contents
The Essentials Vacation Suitcase is intended to provide basic short-term vacation essentials. Contents may vary based on location, availability, stated preferences, sizes, local law, customs restrictions, supplier stock, and operational constraints.
We may substitute items with reasonably comparable items of similar type, quality, or value if the requested or expected item is unavailable. Brands, colors, fabrics, styles, sizes, toiletries, and accessories are not guaranteed.
The Service does not guarantee a perfect fit, preferred brand, exact color, exact style, complete wardrobe replacement, or replacement of your original luggage contents.
15. Health, Safety, Allergies, and Personal Needs
You are responsible for notifying us of relevant sizing needs, allergies, sensitivities, accessibility needs, or other personal requirements. We will use commercially reasonable efforts to consider the information you provide, but we do not guarantee that all preferences, restrictions, allergies, medical needs, religious requirements, or special requests can be accommodated.
The Service is not a medical, pharmaceutical, emergency, childcare, disability-support, or safety service. Do not rely on the Service for medication, medical devices, prescription products, essential health items, passports, visas, legal documents, assistive devices, or other critical needs.
16. What the Service Does Not Cover
The Service does not cover, provide, reimburse, replace, or compensate for:

Your original luggage or its contents.
-
High-value, sentimental, fragile, rare, custom, or irreplaceable items.
-
Jewelry, electronics, cash, documents, passports, visas, medication, medical devices, or professional equipment.
-
Airline baggage fees, airline compensation, baggage claims, or insurance claims.
-
Travel interruption, missed activities, emotional distress, inconvenience, loss of enjoyment, lost profits, lost business opportunities, or consequential losses.
-
Delivery outside covered countries or outside covered service areas.
-
Delivery to incorrect, incomplete, inaccessible, or unconfirmed addresses.
-
Claims caused by your failure to follow the claim process.
-
Claims submitted by or for anyone other than the named customer listed at checkout.
-
Claims for flights other than the one Eligible Flight covered by your purchase.
-
Claims submitted more than 12 months after purchase.
-
Delays or failures caused by airlines, airports, customs, government authorities, suppliers, couriers, accommodations, Kennedy Circle group companies acting outside the scope of the Service, or other third parties.

Any replacement, refund, credit, or compensation beyond what is expressly stated in these Terms.
17. Refund Policy; Refunds Only if a Valid Claim Cannot Be Fulfilled
The Service fee is refundable only if you submit a valid, timely, complete, and properly documented claim for an Eligible Flight, and Luggage Lifeline determines that it cannot provide the Essentials Vacation Suitcase for reasons within its reasonable control.
If we determine that a valid claim cannot be fulfilled, we will refund the Service fee you paid for that purchase to the original payment method within 14 business days, unless a longer period is required by payment networks, banks, or applicable law.
This refund is your sole and exclusive remedy if we cannot provide the Service for a valid claim. We will not owe additional compensation, replacement value, hotel costs, inconvenience payments, travel reimbursement, emotional-distress damages, loss-of-enjoyment damages, airline claim reimbursement, or any other damages, credits, or reimbursements.
The Service fee is non-refundable if:

You do not submit a claim.
-
Your luggage arrives and the Service is not activated.
-
You do not travel.
-
You change, cancel, or miss your flight.
-
You travel to a non-covered destination.
-
You do not activate the Service within 12 months from purchase.
-
Your claim is invalid, late, incomplete, unverifiable, fraudulent, or abusive.
-
The claim is submitted by or for someone other than the named customer listed at checkout.
-
The claim relates to a flight other than the one Eligible Flight covered by the purchase.
-
The destination or accommodation is outside our covered service area.
-
You fail to provide the required airline Property Irregularity Report, PIR reference number, file reference number, or equivalent baggage claim reference.
-
You fail to cooperate with identity verification, claim verification, or delivery coordination.
-
You provide inaccurate, incomplete, outdated, or misleading information.
-
Delivery is completed in accordance with these Terms.
-
Our failure or delay is caused by a force majeure event or by acts or omissions of airlines, airports, governments, customs authorities, couriers, suppliers, accommodations, Kennedy Circle group companies acting outside the scope of the Service, or other third parties outside our reasonable control.
Nothing in this Refund Policy limits any non-waivable rights you may have under applicable consumer-protection laws.
18. Force Majeure
We are not responsible or liable for any delay, failure, or inability to perform caused by events beyond our reasonable control, including, without limitation:

Acts of God or natural disasters.

Severe weather, wildfires, floods, earthquakes, or other emergencies.
-
War, terrorism, civil unrest, strikes, labor disputes, or transportation disruptions.
-
Epidemics, pandemics, public-health orders, or quarantine restrictions.
-
Airport closures, flight disruptions, customs delays, border restrictions, or government actions.
-
Supplier insolvency, supplier closures, courier failures, or infrastructure outages.
-
Power failures, telecommunications failures, cyberattacks, or platform outages.
-
Unavailability of goods, supplies, couriers, delivery routes, or accommodation access caused by circumstances outside our reasonable control.
If a force majeure event prevents fulfillment of a valid claim, we may, where commercially reasonable, offer delayed fulfillment, a substitute delivery method, a credit, or a refund. We will not be liable for any indirect, consequential, special, punitive, or extra-contractual damages caused by a force majeure event.
19. Third-Party Providers; Kennedy Circle Group Companies
We may work with independent suppliers, retailers, couriers, logistics providers, payment processors, identity-verification providers, accommodation staff, technology vendors, Kennedy Circle group companies, and other service providers to operate, support, process, source, pack, deliver, verify, improve, or administer the Service.
Some operational, administrative, technology, procurement, customer-support, marketing, finance, legal, or logistics functions may be performed by one or more Kennedy Circle group companies. Those group companies may act as service providers, processors, contractors, licensors, suppliers, or operational affiliates for the Company.
Unless expressly stated otherwise in writing, Kennedy Circle group companies are not parties to these Terms and are not independently responsible for the Company’s obligations merely because they provide support, services, infrastructure, staff, systems, or operational assistance to the Luggage Lifeline brand.
We are not responsible for the independent acts, omissions, delays, failures, representations, warranties, products, services, or policies of third parties, except to the extent required by applicable law.
20. No Insurance; No Reimbursement or Indemnity
The Service is a logistics planning, sourcing, procurement, packing, and delivery coordination service. It is not insurance, baggage protection, travel protection, a warranty, a reimbursement plan, or an indemnity product.
Your payment purchases access to our logistics readiness, sourcing network, claim intake process, and delivery coordination for one eligible use under these Terms. Your payment does not purchase insurance coverage, financial protection against loss, or reimbursement for the value of your luggage, belongings, travel disruption, or inconvenience.
We do not calculate the Service fee based on the value of your luggage or the risk of airline loss. We do not agree to pay you money based on the amount of your loss. We do not replace your original luggage or compensate you for its contents. Our obligation, if any, is limited to using commercially reasonable efforts to provide the Essentials Vacation Suitcase or, if we cannot provide the Service for a valid claim as described in these Terms, refunding the Service fee you paid.
The Service is not intended to replace travel insurance, baggage insurance, airline baggage compensation, or any rights you may have against an airline, airport, travel provider, insurer, credit-card issuer, or government authority.
Unless expressly stated in writing, Luggage Lifeline, the Company, and the Kennedy Circle group of companies are not affiliated with, endorsed by, sponsored by, or acting on behalf of any airline, airport, insurer, travel agency, hotel, government authority, or baggage-handling provider.
You are solely responsible for pursuing any airline, insurance, credit-card, statutory, or other claim related to your original luggage.
21. Customer Responsibilities
You agree to:

Provide accurate and complete information.

Promptly update us if your accommodation, flight, phone number, or delivery instructions change.

Submit claims within the required time.
-
Provide requested documentation.
-
Cooperate with verification and delivery.
-
Use the Service only for lawful purposes.
-
Treat support staff, suppliers, couriers, and accommodation partners respectfully.
-
Not misuse, reverse engineer, scrape, interfere with, or disrupt our website, app, systems, or Service.
-
Not submit fraudulent, misleading, or abusive claims.
-
Not attempt to transfer, resell, assign, or apply your purchase to another person or flight.
22. Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.
We may collect and process personal information such as contact details, travel details, flight information, accommodation information, clothing sizes, preferences, claim documentation, device information, payment-related information, identity-verification information, and customer-support communications.
We use personal information to provide the Service, verify claims, prevent fraud, process payments, coordinate delivery, communicate with you, improve the Service, comply with law, and protect our rights and users.
You acknowledge that, where permitted by applicable law, your personal information may be shared with or processed by Kennedy Circle group companies and service providers for operational, administrative, technology, customer-support, payment, legal, compliance, fraud-prevention, logistics, sourcing, delivery, and business-management purposes related to the Service.
Depending on where you live, where you travel, and how you use the Service, additional privacy laws may apply, including U.S. federal and state privacy laws, Delaware privacy laws, the GDPR, UK GDPR
Our Privacy Policy explains applicable rights and how to exercise them.
23. Communications and Electronic Notices
You agree that we may communicate with you by email, SMS, phone, push notification, in-app message, or other electronic means regarding your account, booking, claim, delivery, payment, legal notices, security issues, and Service updates.
You are responsible for keeping your contact information current. Notices sent to the contact information you provide will be deemed received when sent, unless prohibited by applicable law.
You consent to receive transactional communications related to the Service. Marketing communications, if any, will be handled in accordance with applicable law and our Privacy Policy.
24. Intellectual Property
The Luggage Lifeline brand, the Service, website, app, software, content, trademarks, logos, designs, text, graphics, photographs, videos, workflows, processes, and other materials are owned by or licensed to the Company, one or more Kennedy Circle group companies, or their licensors and are protected by intellectual-property and other laws.
You may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, create derivative works from, publicly display, publicly perform, or exploit any part of the Service except as expressly permitted by us in writing.
No rights are granted to you except the limited right to access and use the Service for your personal, non-commercial travel-related use in accordance with these Terms.
25. Feedback and Reviews
You may submit feedback, suggestions, reviews, comments, ideas, or other communications about the Service. You grant us, the Company, and the Kennedy Circle group of companies a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use feedback and suggestions for any lawful business purpose without compensation to you.
Nothing in these Terms prevents you from posting or sharing honest opinions about our products, services, or conduct, including truthful reviews, as permitted by applicable law.
You agree not to submit content that is false, misleading, defamatory, unlawful, infringing, abusive, threatening, or fraudulent.
26. Disclaimer of Warranties
To the maximum extent permitted by law, the Service and all products, items, content, software, delivery services, and related materials are provided on an “AS IS,” “AS AVAILABLE,” and “WITH ALL FAULTS” basis.
To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, timeliness, quality, and uninterrupted operation.
We do not warrant that:

The Service will be uninterrupted, error-free, or available in all locations.

Any delivery will occur within a specific timeframe.
-
Any item will match your exact size, preference, brand, color, or style.
-
Any supplier, courier, accommodation, airline, airport, Kennedy Circle group company, or other third party will perform as expected.

The Service will meet your particular needs or expectations.
-
Any airline, airport, insurer, credit-card issuer, or travel provider will provide reimbursement, compensation, or assistance.
Some jurisdictions do not allow the exclusion of certain warranties, so some exclusions may not apply to you.
27. Limitation of Liability
To the maximum extent permitted by law, the Company, Luggage Lifeline, Kennedy Circle group companies, and their respective officers, directors, members, managers, employees, contractors, suppliers, licensors, service providers, affiliates, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, enhanced, or punitive damages, including, without limitation, damages for lost profits, lost revenue, lost business, lost opportunity, loss of enjoyment, emotional distress, inconvenience, replacement costs beyond the Service, loss of data, travel disruption, or personal or property losses related to your original luggage.
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or related to the Service, these Terms, any booking, any claim, any delivery, or any inability to deliver will not exceed the greater of:

The amount you paid for the specific Service booking giving rise to the claim; or

USD $385.
The limitations in this section apply regardless of the theory of liability, whether based in contract, tort, negligence, strict liability, warranty, statute, equity, or otherwise, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, willful misconduct, or other liability that applicable law does not permit us to exclude or limit.
28. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the Company, Luggage Lifeline, Kennedy Circle group companies, and their respective officers, directors, members, managers, employees, contractors, suppliers, licensors, service providers, affiliates, and agents from and against any claims, demands, losses, liabilities, damages, judgments, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

Your violation of these Terms.

Your inaccurate, incomplete, outdated, or misleading information.

Your fraudulent, abusive, or improper claim.
-
Your misuse of the Service.
-
Your violation of applicable law.
-
Your violation of another person’s rights.
-
Third-party claims related to your original luggage or travel arrangements.
-
Any attempt to transfer or apply the Service to a person, flight, or trip not covered by the purchase.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with our defense.
29. Suspension and Termination
We may suspend, restrict, or terminate your access to the Service at any time if we reasonably believe that you have violated these Terms, submitted a fraudulent or abusive claim, created risk for us or others, failed to pay, misused the Service, or acted unlawfully.
Termination does not limit any rights or remedies available to us. Sections that by their nature should survive termination will survive, including payment obligations, disclaimers, limitations of liability, indemnification, dispute resolution, intellectual property, and governing-law provisions.
30. Changes to the Service
We may modify, suspend, discontinue, expand, or restrict any part of the Service at any time, including covered countries, delivery areas, delivery windows, claim requirements, suitcase contents, pricing, features, suppliers, and support channels.
Changes will not materially reduce the Service you already purchased unless required by law, operational necessity, force majeure, supplier availability, safety concerns, or other reasonable circumstances. If a material change affects a booking you already purchased, we will use commercially reasonable efforts to notify you.
31. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date will indicate when the Terms were most recently changed.
If we make material changes, we will provide notice by email, in-app notice, website notice, checkout notice, or another reasonable method. Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms.
If you do not agree to updated Terms, you must stop using the Service.
32. Governing Law
These Terms and any dispute, claim, or controversy arising out of or related to these Terms or the Service are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement below where applicable.
Nothing in these Terms deprives you of any non-waivable consumer-protection rights under the laws of your state or country of residence, if those laws apply.
33. Informal Dispute Resolution
Before initiating arbitration or litigation, you and we agree to first attempt to resolve any dispute informally.

Your notice must include your name, contact information, booking reference, a description of the dispute, the relief requested, and any relevant documentation.
We will attempt to resolve the dispute within 30 days after receiving your notice. If the dispute is not resolved within that period, either party may proceed as permitted below.
34. Arbitration Agreement
To the maximum extent permitted by law, you and the Company agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, any purchase, any claim, any delivery, or any relationship between you and us will be resolved by binding individual arbitration, rather than in court.
The arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, unless the parties agree otherwise. The arbitration will be conducted in English.
The arbitrator will have authority to award the same individual relief that a court could award, subject to the limitations and exclusions in these Terms. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Exceptions
Either party may bring an individual claim in small claims court if the claim qualifies. Either party may also seek temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, security, safety, or unauthorized use of the Service.
Arbitration Location
Unless the parties agree otherwise, arbitration may be conducted by video conference, telephone, written submissions, or in person in Delaware, as determined under the applicable arbitration rules and applicable law.
Arbitration Costs
Payment of arbitration fees will be governed by the applicable arbitration provider rules. We will not seek attorneys’ fees or costs from you in arbitration unless the arbitrator determines that your claim was frivolous or brought in bad faith, or unless applicable law permits such recovery.
35. Class-Action Waiver
To the maximum extent permitted by law, you and the Company agree that each may bring claims against the other only in an individual capacity and not as a plaintiff, class member, representative, or participant in any class action, collective action, consolidated action, private attorney general action, or representative proceeding.
The arbitrator may not consolidate claims of multiple persons and may not preside over any class, collective, consolidated, private attorney general, or representative proceeding.
If this class-action waiver is found unenforceable as to a particular claim, then that claim must proceed in court and not in arbitration, unless the parties agree otherwise.
36. Jury-Trial Waiver
To the maximum extent permitted by law, you and the Company knowingly and voluntarily waive any right to a trial by jury in any dispute, claim, or proceeding arising out of or related to these Terms or the Service.

37. Venue for Non-Arbitrable Claims
For any claim that is not subject to arbitration and is not brought in small claims court, you and the Company agree to the exclusive jurisdiction and venue of the state or federal courts located in Delaware, unless applicable law requires otherwise.
You waive any objection to jurisdiction, venue, or inconvenient forum in those courts.
38. Time Limit to Bring Claims
To the maximum extent permitted by law, any claim or cause of action arising out of or related to these Terms or the Service must be filed within one year after the claim arises. Any claim not filed within that period is permanently barred.
This limitation does not apply where prohibited by applicable law.
39. International Users and Mandatory Local Law
The Service may be purchased by or used by travelers located outside the United States or traveling in countries outside the United States. You are responsible for complying with laws applicable to your travel, purchases, claims, and use of the Service.
Where mandatory consumer, privacy, transportation, e-commerce, or other laws apply and cannot be waived by contract, these Terms will be interpreted to comply with those laws. If any provision conflicts with a non-waivable legal right, that provision will apply only to the maximum extent permitted by law.
40. Assignment
You may not assign, transfer, or delegate these Terms or your rights or obligations under them without our prior written consent.
We may assign, transfer, or delegate these Terms or our rights or obligations to any Kennedy Circle group company or in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, corporate restructuring, or operation of law.
41. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
42. No Waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision or any other provision later. Any waiver must be in writing and signed by an authorized representative of the Company.
43. Entire Agreement
These Terms, together with the Privacy Policy, checkout disclosures, order confirmation, claim instructions, and any policies incorporated by reference, constitute the entire agreement between you and the Company regarding the Service and supersede all prior or contemporaneous understandings, communications, and agreements regarding the Service.

45. Checkout Acknowledgment
At checkout, you may be required to confirm the following:
“I understand that this purchase is valid only for the named customer listed at checkout, for one eligible flight to a covered Mediterranean destination within 12 months from purchase, and that Luggage Lifeline is a logistics planning, sourcing, procurement, packing, and delivery coordination service, not insurance.
I understand that Luggage Lifeline is a brand and service offering operated by or on behalf of [Insert Full Legal Entity Name] as part of the Kennedy Circle group of companies.
I understand that the Service fee is refundable only if I submit a valid claim for an Eligible Flight and Luggage Lifeline cannot fulfill the Service, subject to the Terms of Service.”
